Introduction

Welcome to American Trust Logistics, LLC (“Company,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your use of our website, services, dispatching support, and communication. By using our services or submitting your information through our website, you (“Carrier,” “Driver,” or “Client”) agree to these Terms.

If you do not agree, you must discontinue use immediately.

Nature of Services (Dispatcher, Not Broker)

American Trust Logistics provides independent freight dispatching services, including:

  • Load searching

  • Rate negotiation (as authorized by the carrier)

  • Communication with brokers/shippers

  • Routing and trip planning

  • Document organization

  • Back-office assistance

We do not:

  • Haul freight

  • Take possession of freight

  • Act as a freight broker

  • Guarantee load availability

  • Guarantee income

  • Make safety or compliance decisions on behalf of the Carrier

You acknowledge that we operate strictly as a third-party administrative and dispatching service, and all motor carrier responsibilities remain solely with you.

Carrier Responsibilities

By using our services, you agree to:

  1. Maintain active MC Authority (if applicable), DOT compliance, and all required insurance.

  2. Provide accurate business and equipment information.

  3. Approve all loads before we finalize bookings.

  4. Ensure your vehicle is maintained in safe working condition.

  5. Follow all FMCSA rules, HOS regulations, and legal requirements.

  6. Communicate delays, breakdowns, location changes, or issues promptly.

  7. Provide clear and timely documents (POD, BOL, invoices).

You acknowledge that you are fully responsible for your operation, safety, compliance, and freight decisions.

 

Dispatcher Responsibilities

We agree to provide:

  • Load searches based on your preferences

  • Rate negotiation as authorized

  • Accurate relay of broker/shipper information

  • Timely communication

  • Document transmission (RCs, PODs, BOLs, etc.)

  • Back-office support for billing and paperwork

  • Routing and trip-planning assistance

We do not guarantee:

  • Specific earnings

  • Load volume

  • Market conditions or lane rates

  • Delivery windows determined by brokers or shippers

  • Availability of Power-Only or Hot Shot freight

  • Detention, TONU, or layover payouts (broker-controlled)

We function as your administrative and dispatching partner, not an employer or carrier.

 

Service Fee & Payments

Our dispatch fee is typically 8% of the carrier’s gross load revenue, unless otherwise stated in the signed Dispatch Agreement.

You acknowledge:

  • Fees apply only to loads booked by American Trust Logistics.

  • All completed loads are subject to the agreed fee.

  • Payment terms may be outlined separately in your Dispatch Agreement.

  • Failure to pay may result in suspension or termination of services.

 

Load Booking Authorization

No load will be booked without your consent.

By approving a load verbally, via text, email, or app-based communication, you authorize us to:

  • Negotiate on your behalf

  • Confirm appointments

  • Accept a rate

  • Forward documents and updates

 

Liability Disclaimer

American Trust Logistics is not liable for any damages, losses, or delays arising from:

  • Weather or road conditions

  • Mechanical breakdowns

  • Broker or shipper cancellations

  • Detention or TONU refusal by brokers

  • Incorrect information provided by brokers or shippers

  • Traffic or accident delays

  • Carrier failure to comply with FMCSA rules

  • Loss of freight, damaged freight, or claims

  • Miscommunication originating from the broker/shipper

  • Carrier failure to send documents or follow procedures

All risks associated with freight movement remain with the Carrier.

 

No Guarantee of Earnings

We do not guarantee:

  • Weekly revenue

  • Market stability

  • Load availability

  • Consistent load volume

  • Specific lanes or regions

Carrier acknowledges that freight markets fluctuate and that earnings depend on market conditions, driver availability, and operational decisions.

 

Termination of Services

Either party may terminate dispatching services at any time with written notice.

Termination does not eliminate the Carrier’s responsibility to pay fees for all loads booked prior to termination.

 

Document Accuracy & Recordkeeping

Carrier agrees to:

  • Provide accurate business information

  • Maintain updated insurance and compliance documents

  • Deliver clear, legible PODs/BOLs promptly

  • Retain their own operational records

American Trust Logistics is not responsible for filing taxes or maintaining the Carrier’s compliance records.

 

Communication Policy

Carrier agrees to maintain timely communication.

This includes:

  • Responding promptly to load opportunities

  • Notifying us of delays or emergencies

  • Sending POD/BOL immediately after delivery

  • Keeping an open line for active loads

Failure to communicate may result in missed loads or operational delays.

Governing Law

These Terms shall be governed by and interpreted according to the laws of the State of Georgia, without regard to its conflict of law principles.
